With that statement to the league by the Blazers I think Miles has a good case against Portland if he doesn't get signed by someone...maybe even treble damages.

the owner of portland has money to throw away..... I'm sure he'd be happy to pay the guy double his salary if he got to keep his salary cap space...

But I think the league should step in and say the 10 games have been met unless a league doctor can say that he is unfit to play.

Prior to this whole Darius Miles fiasco, I actually liked Larry Miller. I grew fond of this guy during the '07 draft when he was flat-out just buying draft picks from other teams in an effort to get as many players as possible. I totally respected him for that and remember feeling envious of Blazers fans given the fact that OUR owner is so conservative with his money.

This D-Miles crap is mos-def souring my opinion of Miller though...

I'll 2nd that.... buying draft picks was sweet.... but threatening the league after trying to wiggle out of a contract.. unimpressive

Treble damages are 3x. Is $9M of cap space worth a $54M check to Miles and his attorneys? Then factor in the insurance money it sounds like Portland has received...seems like the insurer could come after them too.

Agreed. Portland shouldn't be let off the hook for signing the guy to a bad contract.

I don't feel for the Blazers one bit. They said the kid could not play anymore and threw him out with the trash much like the Clippers did with Shaun Livingston. Well, Miles can play on that knee he might not be NBA material anymore on that knee, but he can play. The Blazers threatening legal action is insane. What do you think is going to happen when Miles gets his attorneys and the players association involved. They are going to be paying out way more money than it is worth. It is not the leagues fault that the Blazers signed him to a crazy contract, cashed in on the insurance ,and had crack pot doctors pronounce Miles will never play again.:6shoot:

That is if anyone wants Miles, have any team expressed recent intrest, someone get on the phone to Joe and tell him to do a deal that get's rid of Alex Acker or someone on those sort of terms in a sign and trade for Miles! He's a capable enough back-up SF :)

Herrmann is starting to frustrate me, he showed glimpses at seasons beginning but if curry's not going to play him at least get someone to play, furthermore, this gives us more flexibility to put either RIP/AI to the bench or as my line-up suggests both! :)

Didn't understand how this whole 10 day/cap thing worked at first, but after reading a bunch of articles, it's pretty simple.

DMiles wrecks his kneee, Portland calls it a career ender, they file for insurance, Dmiles gets paid by insurance, and his salary is off the cap.

But, DMiles comes back and the NBA says if he can play 10 games in a season, his injury obviously wasn't a career ender, so his salary goes back on the cap, and the insurance company may or may not go after Portland to get their money back.

DMiles can obviously still play, not well, but he can make somebody's 10th spot on the roster. So Portland is looking at some major legal jeopardy, including insurance fraud (imho), from all sides if the try and and intimidate people from letting the kid play.

I believe that the players union picked the doctor who decided Miles was too injured to play. If he is good to go, and the Blazers still have to pay him, shouldn't he play in Portland?

Yup. POR's owner panicked and was extremely stupid with that memo.

Looks like Memphis just extended the middle finger high in the air to Portland.:fight2: It was really dumb to send that email. No doubt Memphis will play Miles in 3 or 4 games and then cut him.
